Terms & Conditions

Terms & Conditions of Service
Effective 3 November 2026

1. About these terms

These terms are between DataBank2U Technologies Sdn Bhd (“DataBank2U”, “we”, “us”), NO. 120-2, Jalan Setia Gemilang BJ/U13 BJ, 40170 Shah Alam, Selangor, Malaysia, and the business that creates an account (“you”). By creating an account, starting a trial or using the Service you agree to them. If you accept on behalf of a company, you confirm you are allowed to bind it.

2. The Service

DataBank2U provides a cloud CRM and business suite: customers, leads, quotations, invoices, support tickets, reports and the modules included in your plan, plus an interface that lets AI apps you connect work with your data (the “Service”). What each plan includes is described on our website. We may improve, change or retire features; if a change removes something material from your plan we will tell you in advance.

3. Your account

  • Give accurate information and keep it up to date.
  • Keep your credentials safe and turn on two-factor authentication for staff where offered. You are responsible for everything done through your account and by the staff and AI apps you authorise.
  • Tell us promptly at [email protected] if you suspect unauthorised access.

4. Free trial

New accounts can try the Service free for 30 days with no payment. At the end of the trial you choose a plan. If you do not, the workspace becomes inactive; we keep your data for the period in section 8 so you can still choose a plan or export it.

5. Plans, fees and payment

  • Fees are in Malaysian ringgit (RM) and are shown on our website and on your invoices. Unless an invoice says otherwise, fees exclude taxes that apply by law, which are added where they apply.
  • The monthly plan is billed monthly and the yearly plan is billed yearly, in advance. Add-on modules and extra company workspaces are priced as shown on our website and are billed yearly together with your plan.
  • Subscriptions renew automatically for the same period until you cancel. You can cancel at any time; the cancellation takes effect at the end of the period you have paid for.
  • Fees already paid are not refundable, including for an unused part of a period, except where the law requires otherwise. The free trial is there so you can decide before you pay.
  • If an invoice is not paid by its due date we may suspend the workspace after reasonable notice. We may change prices for a future period by giving you at least 30 days’ notice before your next renewal.

6. Acceptable use

You must not use the Service to break the law or others’ rights, send spam or malware, store content you have no right to store, attack or probe our systems, bypass limits or security, copy or reverse-engineer the Service, or resell it without our written agreement. We may limit or suspend use that harms the Service or other customers.

7. AI apps and third-party connections

You may connect AI apps (such as Claude, ChatGPT, Cursor or n8n) and other third-party tools. A connected app acts with the permissions of the staff member who connected it. You decide what to connect, you are responsible for what it does with your data and for the terms you accept with that provider, and you can disconnect it at any time. AI output can be wrong; check it before you rely on it, especially for money, tax and legal matters.

8. Your data and data processing

  • It is yours. You own the data and content you put in the Service (“customer data”). We get only the right to host, back up and process it to provide the Service to you. We do not sell it and we do not use it for advertising.
  • Our role. For personal data inside your workspace, you are the data user and we are your data processor under the Personal Data Protection Act 2010. You are responsible for having a lawful basis, any notices and consents you need, and for the accuracy of what you store.
  • What we do as processor. We process customer data only to provide the Service and on your documented instructions (using the Service and these terms are your instructions); keep it confidential and limit access to people who need it; protect it with the measures in our Privacy Notice; help you answer requests from the people whose data you hold; tell you without undue delay if we find a personal data breach affecting your customer data; and make information available to show our compliance.
  • Sub-processors and location. We use the providers listed in our Privacy Notice (hosting in Kuala Lumpur, Malaysia, and security and delivery services). We stay responsible for them and will update that list if it changes.
  • Getting your data out. You can export your data using the tools in your plan, and you can ask us at any time for an export in a common format. After a subscription ends you can export your data for 30 days; we then delete it within a further 60 days, except what the law requires us to keep. Backup copies roll off shortly after deletion.
  • Backups. We keep regular backups for recovery from our own failures. They are not a substitute for your own exports.

9. Availability and support

We aim to keep the Service available and secure and we use reasonable care and skill, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance, and where we can we will warn you in advance. Support is by email at [email protected] during normal business days.

10. Our rights and yours in the software

We and our licensors own the Service, its software, design and brand. You get a non-exclusive right to use it while your subscription is active. If you give us feedback we may use it without restriction. You keep all rights in your customer data and your own logos and content.

11. Confidentiality

Each side will keep the other’s non-public information confidential, use it only for this agreement, and disclose it only to people who need it and are bound to confidentiality, or where the law requires.

12. Disclaimer and limit of liability

Except as these terms say, the Service is provided “as is” and we give no warranties about results, fitness for a particular purpose or that it will meet your needs. To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill or data caused by events outside our reasonable control, and our total liability for any claim is limited to the fees you paid us for the Service in the 12 months before the event. Nothing limits liability that cannot be limited by law.

13. Suspension and ending

You may stop using the Service and cancel at any time as described in section 5. We may suspend or end your access if you seriously or repeatedly break these terms, do not pay, or put the Service or others at risk, after notice where reasonable. Sections that by their nature should continue (data, payment owed, confidentiality, liability, governing law) continue after the end.

14. Changes to these terms

We may update these terms. We will publish the new version here with a new effective date and give at least 30 days’ notice by email of material changes. If you do not agree you may cancel before they take effect; continuing to use the Service afterwards means you accept them.

15. Governing law

These terms are governed by the laws of Malaysia and the courts of Malaysia have jurisdiction. Please contact us first and give us a chance to resolve a problem informally.
